Policy
Elarabeat policy.
Last updated: October 8, 2026. This policy reflects the current Elarabeat version, including Studio lyrics, album download packages and license records, uploaded album review, Community Streaming publishing, Moderation Hold, admin review, disputes, takedowns, and support automation.
1. Provider-aligned use
Your use of Elarabeat must comply with applicable law, this policy, and any provider rules that apply to the underlying tools used in the product. That includes current OpenAI usage rules, Google API terms, and the current ElevenLabs general, music, model-specific, OEM, and prohibited-use terms where applicable.
2. Acceptable use and prohibited conduct
- You may not use Elarabeat for illegal, exploitative, abusive, fraudulent, deceptive, hateful, harassing, or violent misuse.
- You may not use Elarabeat to create, promote, or distribute child sexual abuse material, non-consensual intimate content, extremist propaganda, scams, malware, or unlawful surveillance or impersonation.
- You may not upload or prompt with content unless you have the rights, permissions, licenses, and consents required to use it.
- You may not use Elarabeat to infringe copyright, trademark, publicity, privacy, or other rights, including by uploading media you do not control.
- You may not attempt to bypass safeguards, moderation, account limits, billing limits, or security controls.
3. Music-specific restrictions
If any workflow in Elarabeat uses ElevenLabs Music or other provider music-generation services with similar restrictions, you must not submit prompts or references that violate those provider terms.
- Do not use real artist, songwriter, band, label, song, or album names where the underlying provider disallows them.
- Do not provide copyrighted lyrics, substantial lyric excerpts, or references intended to reproduce a protected work.
- Do not ask the product to clone, imitate, or misrepresent a real person's identity, likeness, or voice without all required rights and permissions.
- Premier Model outputs powered by ElevenLabs may not be used in film, television, radio, or covered multi-platform commercial studio games unless Elarabeat has recorded a separate provider approval for the applicable scope.
- A customer output license does not resell, repackage, sublicense, or transfer access to an underlying provider service, model, account, or API.
Elarabeat presents this customer media as a provider-restricted music-and-cover-art collection. Terms such as album, release, collection, art set, multimedia post, or package describe how Elarabeat organizes and displays the materials; changing the label, pairing the music with artwork, or adding interactive features does not expand customer rights or alter the provider terms that apply to the underlying music output.
- You may not sell, resell, license, sublicense, lease, assign, or otherwise transfer a Premier Model output or claimed rights in it to another person or business.
- You may not place a Premier Model output in a stock-audio, production-music, licensing, marketplace, library, catalogue, database, or repository offering for third parties.
- You may not use a Premier Model output to train, fine-tune, evaluate, benchmark, or build an AI or machine-learning model, dataset, music generator, music library, or competing music or streaming service.
- A separate provider agreement or scope recorded for Elarabeat's owner or platform operation does not expand a customer's download, distribution, sublicensing, stock-use, model-training, or competing-service rights.
4. User content and rights responsibility
You are responsible for any content you upload, enter, submit, generate, edit, publish, distribute, or share through Elarabeat.
- Content includes lyrics, prompts, creative briefs, song titles, album titles, cover art, uploaded images, uploaded audio, ZIP or folder uploads, metadata, AI-assisted outputs, AI-generated outputs, and Community Streaming releases.
- Before generating, verifying lyrics, uploading an album, saving a release, or publishing to Community Streaming, you must confirm that you own or have obtained all rights, licenses, permissions, consents, and clearances needed for that content.
- You may not upload, enter, request, generate, publish, distribute, or share content that infringes or misappropriates another person's copyright, trademark, publicity rights, privacy rights, or other rights.
- Private drafts are not public releases. A private draft can still be held, reviewed, removed, or blocked from publishing if it appears to include protected lyrics, artist imitation, unauthorized samples, trademarked branding, unsafe material, or other rights-sensitive content.
5. Lyrics, copyright, and generated text
- You are responsible for lyrics you manually enter, upload, request, generate, edit, publish, distribute, or share through Elarabeat.
- Do not submit lyrics copied from copyrighted songs, lyrics that are substantially similar to protected works, or lyrics that otherwise violate another party's rights unless you have permission or a valid legal basis.
- Manual lyric verification, automated moderation, copyright-risk screening, and AI closer-look review are assistive tools only. Passing a check does not mean content is lawful, original, non-infringing, cleared, or eligible for publication.
- If lyrics are flagged or blocked, the album may be rejected, Community Streaming publishing may be blocked, and repeated or serious violations may affect account access.
6. Uploaded files and album materials
- You may upload only files you own or have permission to use, including images, audio, lyrics, ZIP packages, folder uploads, and metadata.
- Uploaded materials may be scanned for unsafe files, unsupported formats, malware risk, prohibited content, copyright or IP risk, moderation violations, and rights-sensitive metadata.
- Elarabeat may reject, block, delay, remove, ignore, or require review for uploaded albums, images, audio, lyrics, ZIP contents, folder contents, or metadata.
- If an uploaded image is rejected, flagged, unavailable, or cannot be safely used in a given generation flow, Elarabeat may ignore that upload and regenerate artwork using default server-side control images or other safe defaults.
7. Publishing eligibility and review holds
- Publishing content to Community Streaming or release areas is not guaranteed.
- By choosing Community Streaming, you give Elarabeat a non-exclusive license to host, stream, display, promote, moderate, transcode, and process that release until it is unpublished, subject to normal backup retention, dispute, safety, and legal obligations.
- Provider-generated releases may enter Community Review only when the applicable provider approval includes Community Library publishing or when Elarabeat has not yet activated scope enforcement. Existing public releases are not automatically deleted, hidden, or unpublished when governance settings change.
- Generated albums and uploaded albums may be scanned again before publishing. Uploaded albums and user-provided materials may require more review time than fully Studio-generated albums.
- Automated review or admin review may place a release on Moderation Hold. During review, publishing countdowns, public visibility, edits, or release actions may be paused, delayed, frozen, limited, or blocked.
- Elarabeat may approve, reject, remove, take down, keep private, limit visibility, request more information, or annotate a release if it appears to violate this policy, applicable law, provider rules, or third-party rights.
- Review systems and admins may make mistakes. Users may use the available dispute, support, or admin-review process where the app provides one.
- Guest playback previews and non-entitled playback may be limited, including short previews where Elarabeat applies preview limits.
8. Repeat violations and account enforcement
- Repeated or serious violations may result in warnings, rejected album processing, blocked generation, blocked publishing, content removal, loss of credits where allowed by policy, temporary suspension, or permanent account termination.
- Elarabeat may adopt and enforce a repeat-infringer policy for copyright complaints in accordance with applicable law.
- Attempts to bypass moderation, rights checks, account limits, billing limits, or security controls may lead to enforcement action.
9. Copyright complaints and counter-notices
If you believe content on Elarabeat infringes your copyright or other intellectual property rights, use the support or contact link in the footer. Elarabeat may remove or disable access to disputed material while reviewing complaints, counter-notices, or appeal information.
- A complaint should include the rights owner's name and contact information, a description of the copyrighted work, the Elarabeat URL or location of the allegedly infringing content, a good-faith statement, an accuracy statement, and a physical or electronic signature.
- If Elarabeat supports a counter-notice for a specific complaint, the counter-notice should include enough information to identify the removed content, explain why you believe removal was mistaken, and let Elarabeat contact you about the dispute.
- Copyright notices may be sent to support@elarabeat.com with the subject “Copyright notice.” Elarabeat may request additional information needed to evaluate the notice.
10. AI support summaries
- If Elarabeat uses unresolved or delegated support issues to improve support quality, it may store condensed support summaries for that purpose.
- This support-learning system should use summaries rather than full chat histories unless a separate disclosure says otherwise.
- Unused support-learning summaries are intended to be pruned after 30 days under the planned support memory workflow.
11. Commercial Output License, ownership, and no clearance guarantee
Elarabeat commercial-use rights depend on the plan that was active when the output was generated and, where a third-party provider is involved, the provider rights that apply to that output.
- AI-generated outputs may be inaccurate, incomplete, offensive, non-unique, or unsuitable for your intended use.
- Subject to this policy, applicable law, third-party rights, recorded provider approval, and provider restrictions, the Elarabeat Commercial Output License grants the account holder a perpetual, worldwide, royalty-free, non-exclusive license to possess, download, use, reproduce, modify, distribute, publicly perform, publicly display, stream, monetize, and create derivative works from a paid-plan output, except where a provider-restricted customer-media notice states narrower rights.
- For an output without a provider-restricted customer-media notice, you may authorize distributors, stores, streaming services, publishers, collaborators, and service providers to use the output only as reasonably necessary to distribute, administer, promote, or exploit your release. This limited downstream authorization is not a resale or transfer of access to an underlying provider service, account, model, or API.
- For a customer-created Premier Model output, the provider-restricted customer-media terms in Section 3 control: private download is allowed, public or shared use remains on Elarabeat, and external streaming upload, resale, sublicensing, stock-library use, model training, and use in another music service are not licensed.
- For compliant use of a licensed paid-plan output, Elarabeat will not separately sell or license the exact audio master as an Elarabeat catalog asset. Elarabeat may retain operational copies needed to deliver, host, moderate, secure, support, and operate the platform.
- Ending or downgrading a paid subscription does not by itself revoke a paid-plan output license already granted or remove a completed release from the account. Continued access to hosted copies remains subject to account standing, service availability, provider terms, product changes, retention practices, and this policy.
- Commercial licensing for paid-plan outputs does not guarantee exclusivity, sole ownership against third parties, originality, copyrightability, distributor acceptance, or non-infringement.
- Free plans do not include commercial-use rights. Outputs generated on a free plan, or outside an active paid subscription, remain under Elarabeat's custody and may not be used commercially unless Elarabeat expressly grants written permission.
- An Elarabeat Commercial Output License or receipt is a contractual service record, not a government copyright registration, copyright assignment, certificate of exclusive ownership, ownership guarantee, or transfer of provider technology. It is issued only when Elarabeat has recorded a verified provider-rights basis that includes the Commercial Output License scope.
- Premier Model experiences and applicable output records are identified as Powered by ElevenLabs. Standard Model remains presented as Elarabeat Studio, while Google involvement is disclosed in technical provenance and this policy rather than used as a public co-brand.
- You are solely responsible for reviewing and clearing every output before publication, release, licensing, distribution, advertising, or commercial use.
- You remain responsible for rights clearance, disclosures, metadata, credits, legal review, and any downstream use of the output.
- Elarabeat tools do not provide legal advice, rights clearance, or copyright guarantees. AI moderation, lyric verification, and copyright-risk checks are assistive tools only.
- Elarabeat does not guarantee that any output will be exclusive, original, error-free, lawful, cleared, publication-eligible, or non-infringing.
12. Billing, cycle allowances, and refunds
Elarabeat is an evolving, model-driven service and operates on a use-it-or-lose-it basis. Cycle-based allocations are intended for use during the active billing cycle and do not create stored-value rights unless required by law.
- Included plan allowances, usage cycles, jobs, cover generations, remakes, and similar recurring entitlements reset or expire at the end of the applicable cycle and do not roll over unless Elarabeat expressly states otherwise in writing.
- Except where required by applicable law, subscription fees, used credits, completed jobs, and consumed usage are non-refundable.
- In special circumstances only, Elarabeat may consider reimbursement of unused personal credits, if any, after receiving a clear written explanation for the request. Any such reimbursement is discretionary, limited to the unused personal-credit balance, and does not apply to used or expired cycle allowances.
- Elarabeat may deny refund requests that do not include a reasonable explanation, relate to used credits, or arise from dissatisfaction with normal model variation, evolving model behavior, or policy-enforced moderation outcomes.
12A. Studio credit terms
Studio credits are limited-use units for eligible Elarabeat services. These terms apply to credits you buy separately, receive with a plan, or receive as a bonus or promotion. The applicable offer, checkout, account balance, and plan rules state how many credits you receive, what they can be used for, and when they expire or roll over. Purchased credits currently have the validity shown at purchase; included plan allowances follow their billing-cycle rules.
- Studio credits may be used only for eligible Elarabeat services. They cannot be withdrawn, exchanged for cash or gift cards, converted to another provider's credits, or used as a general payment method.
- Credits belong to the account for which they were purchased or issued. You may not sell, gift, trade, broker, transfer, pool, or otherwise provide credits to another person or account, including by selling or transferring an account or its login access to pass along a credit balance.
- You may not advertise an Elarabeat account or credit balance for sale, accept payment or other value in exchange for access to it, or use a third party to make a prohibited transfer on your behalf.
- We may investigate attempted transfers or misuse and restrict affected credits or account access as permitted by law. The refund and reimbursement rules in Section 12 still apply, and nothing here limits rights that cannot be waived under applicable law.
12B. Reward credit terms
Reward credits are promotional service credits earned through eligible Elarabeat reward activities. They are issued without a separate credit purchase, have no cash value, and may be used only for the eligible services and within the limits and expiration period shown in the reward program or account.
- Reward credits cannot be redeemed for cash or gift cards, converted into purchased credits, sold, gifted, traded, transferred, pooled, or exchanged for anything outside the stated Elarabeat reward benefit.
- You may not sell or transfer an account or its login access to pass along reward credits. Creating or controlling accounts, automating activity, or arranging transactions to farm, resell, or transfer rewards is prohibited.
- We may withhold, reverse, or remove rewards credited in error or obtained through ineligible, reversed, fraudulent, or abusive activity, and may pause reward earning or redemption while we review suspected misuse, subject to applicable law.
- Reward credits follow the program rules displayed when earned. They are separate from purchased Studio credits and do not change the refund or reimbursement treatment of a separately purchased balance.
12C. Shop gifts and personal reward passes
Cash music gifts are purchased separately from earned promotional rewards. At the initial Shop rate, 10 rewards represent 1 cent of eligible Shop purchasing value (1,000 rewards = $1). They are service benefits, separate from Studio generation credits.
- Cash gifts are available in the displayed amounts, with custom gifts in $5 increments up to the displayed maximum. Earned rewards cannot purchase transferable gifts.
- A gift code may be shared with one recipient before it is claimed. It can be claimed once; the first eligible verified account receives the value. If the purchaser locks a gift to an email address, only an account with that verified email can claim it. After claiming, the value is bound to that account and cannot be sold, gifted, transferred, pooled, or converted to cash, except where applicable law requires cash redemption.
- Paid gift value does not expire. A security claim link can expire after 9 or 12 months, or have no link expiration, as displayed at purchase. The purchaser can replace an unclaimed link for free in Shop; this invalidates the old code and preserves the remaining gift value and recipient restriction. Payment refunds reduce only the refunded value. Disputed payments may be held during review.
- Rewards may cover all or part of the eligible personal passes displayed in Shop, with any remaining amount paid by card. The review shows the rewards applied, remaining card amount, and applicable tax at checkout. Rewards apply in whole-cent increments; the minimum USD card payment is $0.50, and unapplied rewards remain in the account. Reserved rewards are debited only when the pass activates. Canceled or expired unpaid checkout releases the reservation. Pass pricing, duration, and monthly renewal are reviewed before activation. A payment card on file and explicit agreement to paid monthly renewal are required. The pass ends on the stated date, then the reviewed monthly subscription price plus applicable tax is charged unless renewal is cancelled in Billing beforehand. A reminder is scheduled one week before a reward pass ends. Existing subscriptions must be managed in Billing; Shop does not replace them.
- Merchandise marked as a preview cannot yet be ordered. Final product details, fulfillment, delivery regions, prices, taxes, and return terms will be shown before checkout opens. Section 12 and all non-waivable consumer rights continue to apply.
13. Service evolution
- Elarabeat may change prompts, models, providers, safety systems, workflows, styles, outputs, limits, layouts, and features over time.
- Generations may differ from prior results even when the same or similar inputs are used.
- Elarabeat may suspend, restrict, or terminate access for abuse, provider-risk, payment issues, safety concerns, or policy violations.
14. Disclaimer of warranties
To the maximum extent permitted by applicable law, Elarabeat and its software, outputs, integrations, and related services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, or uninterrupted operation.
15. Limitation of liability and indemnity
To the maximum extent permitted by applicable law, Elarabeat, its owners, operators, affiliates, licensors, vendors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or business interruption, arising out of or related to your use of, inability to use, or reliance on the product, software, uploads, or outputs.
To the maximum extent permitted by law, Elarabeat's total aggregate liability for any claim arising out of or relating to the service will not exceed the greater of the amount you paid directly to Elarabeat for the service in the 12 months immediately preceding the event giving rise to the claim, or $100 USD.
You are responsible for your use of the product and, to the maximum extent permitted by law, agree to defend, indemnify, and hold harmless Elarabeat and its owners, operators, affiliates, licensors, and service providers from claims, damages, liabilities, losses, and expenses arising from your inputs, uploads, releases, distribution, misuse, or violation of this policy or applicable law.
Nothing in this policy limits or excludes liability that cannot legally be limited or excluded under applicable law.
16. Careers introductions and data
The Careers page lets a signed-in account holder age 18 or older send an expression of interest. An introduction is not an application for an advertised opening, an offer of employment, or a promise of a response. Areas shown on the page describe interests and may be paused by Elarabeat.
We store the account email, name, location or time zone, chosen area, optional public profile link, expertise, experience, reason for interest, optional cover-letter text, and any resume or cover-letter attachment you provide. Attachments are encrypted at rest and available through the owner review workspace. We use this information to review the introduction and, if appropriate, contact you about next steps. An owner invitation creates area-specific questions in your candidate home. We do not request Social Security numbers, identity documents, or sensitive self-identification details in this first step.
You can opt in to email alerts for selected Careers areas and turn them off in your candidate home. To operate and improve the process, we record limited status-page activity, elapsed application time, and document-upload diagnostics. These records are service diagnostics, not a hiring score or a measure of commitment.
AI drafting is optional and requires separate consent. If you choose it, only text extracted from the resume or cover letter you select, or text you paste, is sent to Elarabeat's configured OpenAI provider to suggest shorter wording for your fields. Images and the original PDF, DOCX, or TXT file bytes are not sent to the provider. The original attachment remains available for owner review. Large documents may need a shorter excerpt for AI drafting. The assist may flag a possible mismatch between your material and the area you chose so you can check it; it does not reject, rank, or decide whether to hire you. Suggestions are not saved or submitted automatically. Review and edit every suggestion before you save or submit. When available, the configured provider also checks selected drafting text, generated wording, and your final introduction text for unsafe content. This check may ask you to revise wording; it does not score or decide your introduction. The configured word filter runs even if provider moderation is unavailable.
The current draft and closed-record retention periods are shown in the Careers flow and can be changed in owner settings. A submitted introduction stays in the owner review queue until it is closed or withdrawn. Withdrawing removes its personal details, attachments, and unanswered next-stage task from the active record. Delivered email queue entries are cleared after 90 days. A later hiring process, if offered, will have its own secure forms and terms. Contact support@elarabeat.com with Careers data questions.
17. Website visits and privacy choices
To understand site demand and improve Elarabeat, we count successful page visits in aggregated daily statistics. These counts include the page, whether the request came from a signed-in account or a guest, an approximate phone, tablet, or desktop category, and the referring page or site when a browser supplies it. The statistics table does not keep a guest identifier, IP address, full browser signature, or a person's page history. Daily statistics are kept for up to one year. You can object to future basic site statistics in Privacy choices; necessary security and access logs remain separate.
Detailed visit analytics are optional. When enabled, a browser identifier links guest visits, and signed-in visits can be linked to the account. This allows repeat-visit and page-journey reports. Individual visit events are retained for up to 90 days. Turning detailed analytics off stops new visit-history collection and requests deletion of matching stored history. Clearing browser data or using another device may make a visitor appear new. Referrers and device categories are approximate.
Your country choice in an account profile is self-reported and does not establish where you are physically located or which privacy law applies. Elarabeat may use necessary security records to protect accounts and investigate abuse; those records are not the Website Visits report.
18. Policy updates
Elarabeat may update this policy at any time as the product evolves or as provider rules, legal requirements, or operational needs change. Continued use of the service after an update constitutes acceptance of the revised policy.
